With an hour to set up and an hour to take down
Location: At the Vilano Beach Pier, Park, Pavilion and Parking Area
Contribution Fee: $15 (including sales tax) per day for a 10 square foot display spot.
In order in insure a reserved area, rent is payable monthly
(4 x $15 = $60) the last Sunday of the month.
Pre-approved walk up Vendors are on an if available basis with no reserved space.
It is the responsibility of the Vendor to be certain his/her rent is paid on time.
We encourage you to hand deliver your rent and get a dated receipt.
Any paid rental if not used is not refundable or transferable.

VENDOR APPROVAL PROCESS
The prospective Vendor completes a Vendor Application which provides a detailed description of proposed products and booth setup. Samples may be requested. Vendors are screened based on a number of criteria including types of items, number of items in category of type already in the Market, quality, presentation, vendor style and appearance. It is the discretion of the North Shores Improvement Association, Vilano Beach Main Street and the Market Manager for the selection of type and quantity of Vendors.
Type of Product. Eligible products include, but are not limited to, high quality fruits, vegetables, herbs, seasonings, organics, nuts, honey, cheeses, baked goods, gourmet foods, seafood, meats, herbal oils and vinegars, jellies, sauces, dips, coffees/teas, herb based bath products, plants and hand crafted items.
Product Quality. Vendors must maintain a high standard of product quality.
Presentation. Products must be displayed on tables throughout the booth in a professional and pleasing manor.
Product Restrictions. We restrict the number of Vendors by type of product. If a category of products is already well represented, we will notify the applicant and keep the application pending future openings. Vendors are not permitted to add additional product lines outside the products described on their original Market application. Subsequent additions to the product line must be reviewed and approved.
LICENSES / INSURANCE / REGULATIONS
§
It is the Vendor's responsibility to collect and remit state sales tax to the State of Florida on those items subjected to state sales tax.
§
St. Johns County requires a tax receipt (formerly known as Occupational License). This can be obtained at the County Department of Licensing/ Tax Collection (same as Motor Vehicle licensing), 209-2250.
§
A copy of all licenses applicable to the product must be given to the Market.
§
Vendors must comply with all federal, state, local and special statutes and ordinances regarding public health, safety and welfare.
§
Food items must be prepared in a kitchen certified by the County Health Department and not in a home kitchen.
§
Food licensing is through the FL Dept of Health @ County Permit Building (building & zoning permits), 823-2514,7
§
Prepackaged food must be properly prepared, packaged, labeled and subject to inspection according to law.
§
Scales used to weigh products must meet the standards of the Florida Dept of Agriculture and Consumer Services.
§
Food can be prepared on site for consumption with proper licensing (FL Dept of Restaurants & Hotels).
§
Vendors are responsible for their own personal liability and product liability. The Market is not responsible for any liability arising out of negligent acts of the Vendor or their employees, or for any injuries sustained by employees or Vendors. Vendors should obtain appropriate adequate property, liability and workman's compensation insurance.
MARKET DAY SET UP
§
Check in with Market Manager each day at designated location.
§
Participants will be assigned spaces by the Market Manager based on seniority and vendor balance within the Market.
§
Set up can begin an hour before at 11 am, completed by noon.
§
Please drive very slowly through the market at the beginning and ending of the day.
§
Vendors are expected to remain in their area until 4 pm even if they have sold out of product. Vendors should make every effort to have enough inventory to avoid continually selling out prior to Market end.
§
Pre-paid vendors unable to attend on a given Sunday must advise the Market Manager 24 hours in advance of Sunday to avoid losing the pre-paid space.
§
Pre-paid reserved spots will be held until noon, and then assigned to any waiting occasional vendor. Late vendors may be accommodated in other spots if available. Please notify the Market Manager if you are running late.
§
We will only cancel the Market only under hurricane watch or extreme weather conditions.
§
Vendors are required to properly secure tents against wind and should have gallon jugs of water or sand or other devices to attach to tent poles.
VENDOR RESPONSIBILITIES
§
Vendors are required to bring their own tables and setup, portable tent/canopy, chairs, etc.
§
All vendors are to take their garbage away at the end of the day. If needed, vendors should provide their own garbage receptacles.
§
All products must be priced individually or have signage with prices.
§
All merchandise must be of good quality; no damaged, spoiled, outdated or used merchandise is allowed.
§
Vendors are to maintain their spaces in clean, sanitary and attractive conditions.
§
No cooking will be allowed on site without authorization of the Market Manager.
§
Vendors should be prepared to have bags and change available.
§
All signs and merchandise must remain within the limits of the specified selling space and not interfere with the view of the displays.
§
No animals are permitted within the specified selling space.
§
Break down is not permitted before 4:00 pm.
VENDOR CODE OF CONDUCT
§
Vendors are expected to be courteous to customers, other vendors and Market Staff.
§
Any disagreements should be handled in a constructive and civil manner.
§
Inappropriate behavior (such as loud angry conversation or obscenities) is cause for immediate and/or permanent removal from the Market.
§
Alcoholic beverages are not allowed for sale or consumption.
§
Appropriate attire is required, including shoes and shirts. No bathing suits.
§
Smoking is offensive to most of our health conscious customers. Therefore, as a courtesy, vendors are asked to take their smoking breaks away from booths and customers.
§
No person shall make a public outcry, do “hawking”, or give any musical or other entertainment for the purpose of drawing customers or attracting attention without prior permission from the Market Manager.
§
Solicitation of any type by non-vendors (distribution of flyers, requests for money, petitions, etc.) is not allowed within the Market boundaries. Please inform the Market Manager if you see solicitation occurring.
ENFORCEMENT OF RULES
§
Any grievance regarding the actions of other vendors should be brought to the attention of the Market Manager, and not directed to the Vendor in question. If the Market Manager is unable to resolve the grievance, you may bring your grievance before the Board of the North Shores Improvement Association.
§
All Vendor concerns should be reported to the Market Manager. The Market Manager is responsible to address your concerns and bring your concern before the North Shores Improvement Association Board.
§
Behavior that is disruptive to Market activities will not be tolerated and will result in immediate termination of the Vendor Agreement.
§
Any dishonest practice will constitute immediate removal from the Market.
§
Any violation or non-compliance is cause for immediate termination of this Agreement.
ROLE OF THE MARKET MANAGER and NSIA
§
The Market Manager has been authorized by the North Shores Improvement Association to enforce these Rules and Regulations and has the authority to remove any Vendor from the Market.
§
North Shores Improvement Association and its affiliate Vilano Beach Main Street reserve the right to make changes or amendments to these rules as they are justified. NSIA/Vilano Beach Main Street is the Market Authority permitted by St. Johns County and holds an Agreement for operation with St. Johns County.

By execution of this Agreement hereof, the undersigned releases and discharges and agrees to hold harmless the County of St. Johns and the North Shores Improvement Association or its affiliate Vilano Beach Main Street from any and all claims, demands, action or right of action arising out of or by reason of the use of the Vilano Beach Sunday Market, except due to the negligence of the County or NSIA and its affiliate. The Vendor/Farmer agrees to protect, defend, indemnify and hold harmless the North Shores Improvement Association, its officers, Board members agents and volunteers from and against all claims demands, expense and liability arising out of injury or death to any person or the damage, loss or destruction of any property which may occur or grow out of any act or omission of the Vendor and its agents, or any and all costs, expenses and attorney fees incurred by the Vendor as a result of any claim, demands or causes of action arising out of operating as a Vilano Beach Sunday Market Vendor. I have received, read and understand the terms and conditions described on this application and agree to comply with regulations applicable to your products.
